Enlightening new case law on transport (CMR)
Purpose
To receive relevant and instructive information and to be able to take into account how the higher courts consider that a case of damage to goods should be "properly" resolved: whether and under what conditions the carrier is liable for the damage and to what extent.
Main themes
Transport or freight forwarding - what difference does it make? (3 circuit court decisions)
Serious negligence on the part of the carrier:
- on the basis of the 2020-2024 judgments on the choice of night-time parking spaces (review of 4-5 judgments, including the new Supreme Court judgment).
- transport of temperature goods (2022 decision after 2021 Supreme Court decision sending the case back to the district court).
Who is liable for SENT fines in Poland: the principal, the freight forwarder or the carrier? (District Court decision)
Failure to load or secure the goods?; obligations of the consignor and the carrier, liability; apportionment of damages between the consignor and the carrier (Circuit Court decision + Circuit Court decision discussed at the 2018 Nov. training).
Damage to goods intact, refusal by consignee to accept, return shipment, whether damage occurred before or after consignee's refusal, multiple reports, amount of damage and costs, dispute over packaging and attachment (district court decision).
Delay, dispute over time agreement, deadline and form for filing notice of damages, amount of damages, amount of compensation, set-off (Circuit Court decision).
Reciprocal claims (damages and carriage charges), amount of damages, limitation, set-off.
