Explanations and comments

  • The opposing party's or representative's assertion of a factual fact is often a bare assertion that requires proof. A technical expert's opinion (expert opinion) on a factual issue is a strong piece of evidence in civil proceedings that can decide the outcome of a dispute.

  • In the case of major damage outside Estonia, it is advisable to involve an independent surveyor to carry out the necessary procedures on the spot. The CMR Consultant will manage and organise the documentation of the damage and will issue an expert report either jointly or separately.

  • An assessment of the suitability/failure of the packaging or loading and securing, as well as of the conformity/deficiencies of documents and formalities, can also be made on the basis of photographs, commercial and transport documents, explanatory letters, e-mails and other correspondence and information, provided that sufficient material is available.

  • A legal assessment of the existence or not of the carrier's liability makes it possible to anticipate the outcome of the dispute and to assess the different perspectives of the various actions, which in turn allows better decisions to be taken: to bring an action, to avoid bringing an action, to reach a compromise for the "right amount", to set off, to assign a claim, etc.
